The “Good Practices on Alternatives to Detention in return procedures” is a document aimed at providing advice on, and assistance to Member States in relation to alternatives to detention, as stated in article 48(2)(d) of the EBCG regulation. The document primarily relies on desk research and presents the applicable EU and international legal framework. Notwithstanding, it also focuses on delivering a more practical approach based on MS’ experts contributions, namely by identifying the current state of play and challenges identified by the MS, while pointing out possible solutions and ways forward to tackle the identified challenges in the area of return and alternatives to detention.
